1. INTRODUCTION AND ACCEPTANCE

1.1 Agreement to Terms
Welcome to Dimension Portal (“we,” “us,” “our”), operated by Dimension Portal Limited, a company incorporated in New Zealand (Company Number: 9429051052406). By accessing or using the Dimension Portal platform, including our website (dimensionportal.io), mobile applications (iOS and Android), and related services (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”).

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE PLATFORM.

1.2 Age Requirement
You must be 18 years of age or older to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

1.3 Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or in-app notification. Your continued use of the Platform after changes become effective constitutes acceptance of the modified Terms.

2. DEFINITIONS

“Account”: Your registered user profile on the Platform
“Dimension Dollars” (DD or Ð): In-app currency usable exclusively at Dimension Festival events for purchasing products from participating vendors
“Festival”: Any live event organized or licensed by Dimension Portal Limited where the Platform’s in-app currency and marketplace features are active
“Vendor”: A registered merchant authorized to sell products at Festival events via the Platform
“User” or “You”: Any individual using the Platform, including customers and vendors
“Content”: Any text, images, videos, audio, data, or other materials uploaded, posted, or transmitted via the Platform
“NFC Bracelet”: Near-field communication wristband provided to Festival attendees for payment processing

3. PLATFORM SERVICES

3.1 Service Description
Dimension Portal provides:

Festival Experience Enhancement

  • In-festival marketplace for vendor product purchases
  • Interactive quest system with achievements and badges
  • Event lineup and schedule information
  • Interactive festival map (static map with zoom/scroll functionality)

Digital Wallet System

  • Dimension Dollars (DD) in-app currency for festival purchases only
  • NFC bracelet integration for contactless payments (uses your Account balance)
  • Peer-to-peer DD transfers between users
  • Purchase history and transaction tracking

Encrypted Messaging

  • End-to-end encrypted private messaging between users
  • Configurable self-destruct timer (1 minute to 24 hours after being read)
  • Self-contained communication within the Platform only

Media Content

  • Free streaming video and audio content libraries
  • Multiple audio mix options per video
  • Chromecast and AirPlay casting support
  • Available on web and mobile apps

Vendor Services

  • Product listing and inventory management
  • Payment processing via QR code or NFC bracelet scanning
  • Transaction history and sales analytics
  • Payout processing to registered bank accounts

3.2 Service Availability

  • The Platform is provided “as-is” without uptime guarantees
  • We may suspend or terminate services for maintenance, upgrades, or operational reasons
  • Festival-specific features are only available during active events
  • Geographic restrictions may apply based on payment processing capabilities

4. ACCOUNT REGISTRATION AND SECURITY

4.1 Account Creation
To use the Platform, you must:

  • Provide accurate, current, and complete registration information
  • Maintain and update your account information
  • Be at least 18 years of age
  • Comply with all applicable laws in your jurisdiction

4.2 Account Security
You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Immediately notifying us of unauthorized access or security breaches
  • Using a strong, unique password

4.3 Account Termination
We reserve the right to suspend or terminate your account:

  • For violation of these Terms
  • For fraudulent or illegal activity
  • For abusive behavior toward other users or vendors
  • At our discretion, with or without notice

Upon termination:

  • You lose access to all Platform services
  • Unused Dimension Dollars may be refunded at our discretion (see Section 5.6)
  • Your personal data will be anonymized or deleted per Section 11

5. DIMENSION DOLLARS (IN-APP CURRENCY)

5.1 Nature of Dimension Dollars
Dimension Dollars (DD or Ð) are:

  • In-app currency ONLY usable at physical Dimension Festival events
  • NOT convertible to real currency except through our official refund process
  • NOT transferable outside the Platform or to third-party services
  • NOT redeemable for cash at point-of-sale locations
  • Event-specific and have no value outside festival venues

5.2 Purchasing Dimension Dollars
DD can ONLY be purchased via dimensionportal.io using:

  • Credit/debit cards (processed by Stripe)
  • Bank transfers (New Zealand domestic)

Purchase Options:

  • Suggested packages: Ð50, Ð100, Ð200, Ð500
  • Custom amounts: Users may enter any amount
  • Minimum purchase: 1 Dimension Dollar
  • No maximum purchase limit, subject to payment processor restrictions
  • Exchange rate: Variable – set by Dimension Portal and always available for viewing at https://dimensionportal.io/currencies/

5.3 Mobile App Purchase Restrictions
CRITICAL: The mobile app does NOT process Dimension Dollar purchases. All purchases redirect to dimensionportal.io via external browser to ensure compliance with Apple App Store and Google Play Store policies.

5.4 Use of Dimension Dollars
Dimension Dollars may be used for:

  • Purchasing products from vendors at Festival events
  • Peer-to-peer transfers to other Platform users

DD CANNOT be used for:

  • Tipping or donations outside the Platform
  • External purchases
  • Conversion to other cryptocurrencies or tokens

5.5 Peer-to-Peer Transfers

  • Users may send Dimension Dollars to other registered users
  • Transfers are instant and irreversible
  • Sender is responsible for verifying recipient identity
  • We are not liable for transfers sent to wrong recipients

5.6 Refund Policy for Dimension Dollars
Eligibility:

  • Minimum refund amount: 10 Dimension Dollars
  • Dimension Dollars must be unused (not spent on vendor products)
  • Account must be in good standing (no violations)

Restrictions:

  • No refunds during active Festival events (commitment upon entry)
  • Refund rate: Available on https://dimensionportal.io/currencies/
  • Processing fee: 5% of refund amount (covers payment processor costs)
  • Processing time: 5-10 business days to original payment method

Refund Abuse Prevention:

  • Accounts with 3+ immediate refunds (within 24 hours of purchase) may have refund privileges suspended
  • Suspicious refund patterns may result in account review or termination

5.7 No Earning of Dimension Dollars
DD cannot be earned through Platform activities. Specifically:

  • Quest completion rewards badges and achievements only (no monetary value)
  • No referral bonuses, promotional credits, or gameplay rewards in DD
  • Dimension Dollars can ONLY be obtained via purchase on dimensionportal.io

5.8 Expiration and Forfeiture

  • DD do not expire while your account is active
  • Upon account termination:
    • Unused DD may be refunded at our discretion
    • We reserve the right to forfeit DD obtained through fraudulent means
    • Refunds subject to verification of purchase source

6. MARKETPLACE AND VENDOR TRANSACTIONS

6.1 Vendor Product Listings

  • All products sold via the Platform must be approved by Festival organizers
  • Vendors are responsible for accurate product descriptions, pricing, and inventory
  • Product availability is not guaranteed and may change without notice

6.2 Payment Processing
Transactions are processed using:

  • QR Code Scanning: Customer displays QR code, vendor scans to complete purchase
  • NFC Bracelet Tap: Customer taps bracelet to vendor’s NFC reader

All payments are final and non-refundable once processed (see Section 6.5)

Important: The NFC bracelet is linked to your main Account balance. There is no separate “bracelet balance” – all payments use your Dimension Dollars account balance.

6.3 Transaction Fees

  • Vendor Commission: Agreed upon in Individual Vendor Contracts
  • Displayed to vendors before confirming sale
  • Automatically deducted from vendor payout

6.4 Order Fulfillment
Vendors are responsible for fulfilling orders in a timely manner. Dimension Portal is not responsible for:

  • Product quality or accuracy
  • Delivery delays or errors
  • Vendor disputes or refund requests

6.5 Refunds and Disputes

  • Customer-Vendor Disputes: Must be resolved directly between parties
  • Dimension Portal may mediate at our discretion but is not obligated to do so
  • No automatic refunds: All sales are final unless vendor agrees to refund
  • Disputed transactions may be investigated; fraudulent vendors may be banned

7. MEDIA CONTENT

7.1 Content Access
All registered users receive full access to our media streaming library at no cost. This includes:

  • Full-length video content
  • All available audio tracks
  • HD & 4K video quality (where available)
  • No time restrictions

Content can be accessed on:

  • dimensionportal.io web platform
  • iOS and Android mobile apps (streaming only)

Content is licensed, not sold (see Section 9.2).

7.2 Future Changes
We reserve the right to introduce paid content tiers in the future. If we do so, we will:

  • Provide advance notice to users
  • Implement In-App Purchase for iOS users in compliance with App Store guidelines
  • Update these Terms accordingly

8. MESSAGING AND COMMUNICATIONS

8.1 End-to-End Encryption

  • Private messages are end-to-end encrypted
  • Only sender and recipient can decrypt messages
  • Dimension Portal cannot read message content

8.2 Message Storage and Deletion

  • Unread messages: Stored on servers until read (maximum 24 hours)
  • Read messages: Automatically deleted based on self-destruct timer
    • Default: 1 hour after first read
    • Configurable: 1 minute to 24 hours (user-selectable per conversation)
  • After 24 hours unread: Messages permanently deleted from servers
  • Users cannot recover deleted messages

8.3 Prohibited Communications
You may not use messaging for:

  • Harassment, threats, or abusive content
  • Spam or unsolicited commercial messages
  • Sharing illegal content or coordinating illegal activity
  • Impersonating others or fraudulent schemes

8.4 Reporting and Moderation

  • Users can report abusive messages via in-app reporting
  • Reported users may be investigated and banned
  • While we cannot read encrypted content, we may analyze metadata (frequency, timing) to detect abuse

9. INTELLECTUAL PROPERTY RIGHTS

9.1 Platform Ownership
Dimension Portal Limited owns all rights to:

  • The Platform’s software, design, and functionality
  • Dimension Portal trademarks, logos, and branding
  • Quest content, event data, and platform-generated content

9.2 User Content License
By uploading content (profile photos, vendor product images, etc.), you:

  • Grant us a license to display, distribute, and promote your content
  • Represent you have the legal right to use and license the content
  • Warrant content does not infringe third-party intellectual property
  • Retain ownership of your content, but license us to use it

License Terms:

  • Worldwide, non-exclusive, royalty-free, sublicensable
  • Duration: While content remains on Platform, plus reasonable archival period
  • Purpose: Operating, promoting, and improving the Platform

9.3 Copyright Infringement
If you believe content infringes your copyright, email [email protected] with:

  • Description of copyrighted work
  • Location of infringing content (URL/screenshot)
  • Your contact information
  • Statement of good faith belief
  • Statement under penalty of perjury that you own rights
  • Physical or electronic signature

10. NFC BRACELETS AND FESTIVAL ACCESS

10.1 Bracelet Ownership

  • Festival ticket entitles you to one NFC bracelet
  • Bracelet remains your property as a keepsake after the event
  • NFC chip ownership: Dimension Portal Limited
  • Data stored on chip: Tag UID linked to user’s account. All data is stored on our server, NOT the bracelet.

10.2 Bracelet Usage

  • Used for contactless payments at Festival vendors using your Account balance
  • Links to your Platform account and DD balance
  • Must be worn on wrist for security and functionality

10.3 Lost or Stolen Bracelets

  • Report lost bracelets immediately via Platform or Festival staff
  • We will deactivate bracelet and issue replacement (if available)
  • You are liable for unauthorized transactions before reporting loss

10.4 Bracelet Return

  • Bracelets are NOT required to be returned
  • Most attendees keep bracelets as memorabilia
  • NFC chip is automatically deactivated post-Festival

11. PRIVACY AND DATA PROTECTION

11.1 Data Collection
We collect:

  • Account information (name, email, phone)
  • Transaction history and wallet balance
  • Location data (festival entry/exit, in-app map usage)
  • Device information (IP address, OS version)
  • Usage analytics (feature interaction, session duration)
  • Crash reports and diagnostics (via Sentry)

11.2 Data Usage
Your data is used for:

  • Providing Platform services
  • Processing transactions
  • Improving user experience
  • Security and fraud prevention
  • Compliance with legal obligations

11.3 Data Retention

  • User metadata: Anonymized and retained indefinitely for analytics
  • Encrypted messages: Deleted based on self-destruct timer (1 minute to 24 hours after being read)
  • Transaction history: Retained for reconciliation and tax compliance
  • Account deletion: Personal details deleted, transactional data anonymized

11.4 Third-Party Services
The Platform uses third-party services that have their own privacy policies:

  • Stripe – Payment processing
  • Sentry – Crash reporting and diagnostics
  • Google Cast SDK – Chromecast functionality

11.5 Data Deletion
To delete your account:

  • Log in to dimensionportal.io
  • Go to “My Account” → “Account Settings”
  • Click “Delete Account”
  • Confirm deletion (irreversible)

Upon deletion:

  • Personal information permanently deleted
  • Transaction history anonymized (vendor payouts require historical data)
  • Unused DD forfeited (unless refund requested before deletion)

11.6 International Data Transfers

  • Data stored on servers in New Zealand, Google Cloud, Cloudflare
  • EU/EEA users: Data may be transferred outside EU with appropriate safeguards
  • California users: See CCPA rights in Section 11.8

11.7 GDPR Compliance (EU Users)
If you are in the EU/EEA, you have rights to:

  • Access your personal data
  • Rectify inaccurate data
  • Request data deletion (right to be forgotten)
  • Object to data processing
  • Data portability (export your data)

11.8 CCPA Compliance (California Users)
California residents have rights to:

  • Know what personal data we collect
  • Delete personal data (with exceptions)
  • Opt-out of data sales (we do NOT sell your data)

12. PROHIBITED CONDUCT AND CONTENT

12.1 User Conduct
You agree NOT to:

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Transmit viruses, malware, or harmful code
  • Reverse-engineer, decompile, or hack the Platform
  • Use automated bots or scrapers
  • Create multiple accounts to circumvent bans
  • Engage in fraudulent transactions or chargebacks

12.2 Content Restrictions
You may not upload or transmit:

  • Illegal content (child exploitation, terrorism, etc.)
  • Hateful, discriminatory, or violent content
  • Sexually explicit or pornographic material
  • Content that violates others’ privacy or publicity rights

12.3 Prohibited Vendor Products
Vendors may NOT sell:

  • Illegal substances: Drugs, narcotics, or controlled substances
  • Weapons: Firearms, explosives, knives, or tactical gear
  • Alcohol and tobacco: Including vaping products and e-cigarettes
  • Adult content/services: Sexually explicit materials or services
  • Counterfeit goods: Fake designer items or pirated media
  • Live animals: Pets, livestock, or wildlife
  • Fireworks/explosives: Pyrotechnics or dangerous materials
  • Stolen property: Items obtained illegally
  • Human body parts: Organs, tissue, or biological materials
  • Prescription medications: Without proper licensing
  • Items prohibited under New Zealand law

13. VENDOR-SPECIFIC TERMS

13.1 Vendor Registration
To become a vendor:

  • Complete vendor application on dimensionportal.io
  • Provide business registration documents (if applicable)
  • Agree to Vendor Terms & Conditions (separate document)
  • Undergo approval by Festival organizers

13.2 Vendor Obligations
Vendors must:

  • Accurately list products with correct descriptions and pricing
  • Maintain adequate inventory for listed products
  • Fulfill orders promptly and professionally
  • Comply with all applicable health, safety, and food regulations (if applicable)
  • Possess required licenses (food handling, liquor, etc.)

13.3 Vendor Payouts

  • Payouts processed within 30 days of Festival close
  • No minimum payout threshold
  • Payment via bank transfer to registered account
  • Commission deducted as per Vendor Contract

13.4 Vendor Termination
We may terminate vendor accounts for:

  • Selling prohibited products (see Section 12.3)
  • Fraudulent transactions or customer complaints
  • Failure to fulfill orders
  • Violation of Festival rules or local laws

14. LIABILITY AND INDEMNIFICATION

14.1 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Dimension Portal Limited is NOT LIABLE for:

  • Indirect, incidental, or consequential damages
  • Lost profits, data, or business opportunities
  • Errors, interruptions, or service outages
  • Unauthorized access to your account
  • Third-party content (vendor products, user messages)
  • Physical injuries or property damage at Festival events
  • Quality or safety of vendor products

Maximum Liability: Our total liability to you is limited to:

  • Amount you paid to Dimension Portal in the 12 months before the claim, OR
  • $100 NZD

Whichever is greater.

14.2 Festival Liability Waiver
BY ATTENDING FESTIVALS, YOU ACKNOWLEDGE:

  • Festival attendance involves inherent risks (crowds, weather, physical activity)
  • You attend at your own risk
  • Dimension Portal is not liable for:
    • Personal injuries (slips, falls, crowd injuries)
    • Lost or stolen property
    • Illness or medical emergencies
    • Actions of other attendees or third parties

Emergency Disclaimer: While we provide first aid and security, we are not responsible for medical outcomes.

14.3 User Indemnification
You agree to indemnify and hold harmless Dimension Portal Limited, its officers, directors, employees, and agents from:

  • Claims arising from your use of the Platform
  • Your violation of these Terms
  • Your infringement of third-party rights
  • Content you upload or transmit
  • Transactions with vendors or other users

15. DISPUTE RESOLUTION

15.1 Governing Law
These Terms are governed by New Zealand law, without regard to conflict of law principles.

15.2 Jurisdiction
Any disputes must be brought in the courts of Auckland, New Zealand. You consent to exclusive jurisdiction and venue in Auckland.

15.3 Informal Resolution
Before filing a lawsuit, you agree to:

  • Email [email protected] describing the dispute
  • Allow 30 days for us to attempt resolution
  • Negotiate in good faith

15.4 Class Action Waiver
You agree to resolve disputes individually, not as part of class actions, consolidated actions, or representative proceedings.

16. TERMINATION AND SURVIVAL

16.1 Termination by You
You may terminate your account anytime by:

  • Logging into dimensionportal.io
  • Going to “My Account” → “Delete Account”
  • Following the deletion process

16.2 Termination by Us
We may terminate your account:

  • Immediately for material breach of these Terms
  • With 30 days notice for convenience
  • Immediately for illegal activity or fraud

16.3 Effects of Termination
Upon termination:

  • You lose access to all Platform features
  • Unused DD may be refunded at our discretion (see Section 5.6)
  • Your content may be deleted (except as required for legal/financial records)

16.4 Survival
The following sections survive termination:

  • Section 9 (Intellectual Property)
  • Section 14 (Liability and Indemnification)
  • Section 15 (Dispute Resolution)
  • Section 11 (Privacy, as applicable)

17. MISCELLANEOUS

17.1 Entire Agreement
These Terms constitute the entire agreement between you and Dimension Portal Limited, superseding prior agreements or understandings.

17.2 Severability
If any provision is found unenforceable, the remaining provisions remain in full effect.

17.3 Waiver
Our failure to enforce any provision does not waive our right to enforce it later.

17.4 Assignment
You may not assign these Terms. We may assign our rights to affiliates or successors.

17.5 Force Majeure
We are not liable for delays or failures due to events beyond our control (natural disasters, pandemics, government actions, etc.).

These Terms are drafted in English. Translations are for convenience only; English version controls.

18. APPLE APP STORE & GOOGLE PLAY COMPLIANCE

18.1 In-App Currency Disclosure
Dimension Dollars are NOT in-app purchases subject to Apple/Google fees because:

  • DD are only usable at physical festival events (not digital goods)
  • DD cannot be purchased in-app (redirects to external browser)
  • DD are not convertible to real currency (except refunds)
  • Platform is not a “game” or “entertainment app” selling virtual items

18.2 Media Content
All media content (audio and video streaming) is provided free of charge to all registered users. There are no paid content tiers or subscriptions.

18.3 Payment Processor
All payments are processed by Stripe, Inc., not Apple/Google:

  • Stripe’s terms apply to all transactions: https://stripe.com/legal
  • Dimension Portal acts as merchant of record
  • Apple/Google do not handle payments or provide customer support for transactions

19. SPECIAL PROVISIONS FOR NEW ZEALAND USERS

19.1 Consumer Guarantees Act
Nothing in these Terms excludes or limits your rights under the New Zealand Consumer Guarantees Act 1993 where applicable.

19.2 Fair Trading Act
We comply with the Fair Trading Act 1986 and represent our services accurately.

19.3 Privacy Act
We comply with the Privacy Act 2020 and the Privacy Principles therein.
